基於水資源之永續利用及考量原有各水權人權益，同時兼顧河川生態環境，水權引用水量之審核除自需求面考量應以其「事業所必需者」為限（水利法第17條）外，於供給面方面，亦須根據水文測驗結果，考量區域內水源之水量水源在一定時期內之通常保持之水量，是否足以供給申請人事業所必需者（水利法第21條）。同法細則第15條第2項將地面水之「通常保持之水量」修正為「流量超越機率百分之八十五之水量」。另水權登記審查作業要點第4點亦明訂水權水量核准之各項條件，即主管機關審核水權之引用水量時，應參酌引水地點之各月水文狀況、其上、下游已核准水權水量、環保基流量及事業所需用水量覈實核給。簡言之，地面水水權之審核，於供給面需綜合考慮申請引水位置之水文狀況、與其上下游有關係之已核准水權水量、環保基流量等資料。 為落實上開水利法規定，並建立科學化之供給面水量審核參考基準，本署已於101至103年委託辦理完成「全台河川水系地面水可用水量計算資訊系統」建置計畫，完成公告之全台中央管河川24水系、跨省市河川2水系及縣（市）管河川92水系之地面水可用水量GIS作業平台計算資訊系統建置。該系統依據前述水利法規定之水文分析、水權檢核原則，提供河川水權管理區段位置每日更新之水權及可用水量資訊，此外亦提供不同流量超越機率水量推估結果及臨時使用權核算參考等功能。 為因應前述系統之後續工作，本計畫除將持續維護「地面水可用水量計算系統」之各項功能，並提供其更穩定化與便利之使用介面，同時因應縣市改制相關管理機關之調整，擴大系統相關推廣服務範圍，使中央及地方政府核辦人員熟悉系統之操作。此外，在中央管河川及跨省市河川26水系中，其中17水系有水庫壩堰增闢水源或調節運用情形，為完善可用水量計算之每個環節，擬於本年度探討增闢水源水權核辦機制，建立具理論基礎與實務考量之檢核方法，俾作為主管機關施政之參考。

The determination of water rights can be divided into two aspects: demand and supply. The former should be based on the actual demand amount of the user. For the latter, the amount of water that is regularly available to the area in question within a certain period of time must be calculated from hydrological tests to see whether it is sufficient for the applicant’s purposes. In view of these provisions, the Water Resources Agency constructed the Surface Water Availability Calculation System (SWACS) in Taiwan between 2012 and 2014. This system provides daily updates on the water rights and the amount of water available for the application of new water rights for different sub-watersheds based on hydrological analyses specified in the Water Act. The calculation ensures preservation of all existing prior water in the river. In addition to maintaining the functions of the SWACS, this annual project also establishes examination mechanisms for reservoir water rights applications for the reference of the relevant authorities.
